1. Acceptance of Terms

By downloading, installing, or using Checkin ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Checkin is a social coordination application that helps friends see when others are available to hang out. The App provides features including:

• Real-time availability status updates
• Group creation and management
• Friend connections and social coordination
• Optional Discord integration for automatic status updates
• Push notifications for friend activity
• Event creation and coordination

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years of age to use the App
• One person may not maintain more than one account

3.2 Account Security

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. User Conduct

You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Harass, abuse, threaten, or intimidate other users
• Impersonate any person or entity
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the App or other users' accounts
• Use the App to spam, solicit, or send unsolicited messages
• Scrape, data mine, or use automated systems to access the App
• Share content that is obscene, defamatory, or infringes on others' rights
• Interfere with or disrupt the App's functionality or servers

5. Content and Intellectual Property

5.1 Your Content

• You retain ownership of any content you post through the App (profile information, status updates, etc.)
• By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content as necessary to provide the App's services
• You represent that you have the right to post any content you share through the App

5.2 Our Intellectual Property

• The App, including its design, features, graphics, and code, is owned by Checkin and protected by intellectual property laws
• You may not copy, modify, distribute, sell, or lease any part of the App
• "Checkin" and associated branding are trademarks of Checkin

6. Third-Party Services

6.1 Discord Integration

• The optional Discord integration feature connects your availability status with Discord voice channel activity
• This integration requires separate authorization and is subject to Discord's Terms of Service
• We are not responsible for Discord's functionality or changes to their API

6.2 Other Integrations

• The App may integrate with other third-party services
• Your use of third-party services is subject to their respective terms and privacy policies
• We are not responsible for third-party service functionality or availability

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the App, you consent to our Privacy Policy.

8. Notifications

By using the App, you consent to receive:

• Push notifications about friend activity and events
• Service-related communications
• Updates about the App

You can manage notification preferences in your device settings or within the App.

9. Termination

9.1 Your Rights

You may stop using the App and delete your account at any time through the App settings.

9.2 Our Rights

We reserve the right to suspend or terminate your access to the App:

• If you violate these Terms
• If we suspect fraudulent, abusive, or illegal activity
• For any reason, with or without notice

9.3 Effect of Termination

• Upon termination, your right to use the App ceases immediately
• We may delete your account data in accordance with our Privacy Policy
• Sections of these Terms that by their nature should survive termination will remain in effect

10. Disclaimers

10.1 "As Is" Service

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Guarantee

• We do not guarantee that the App will be uninterrupted, secure, or error-free
• We do not guarantee the accuracy or reliability of any information obtained through the App
• We do not guarantee that defects will be corrected

11. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed $100 or the amount you paid to use the App in the past 12 months, whichever is greater
• This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory

12. Indemnification

You agree to indemnify and hold harmless Checkin, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity

13. Changes to Terms

• We may modify these Terms at any time
• We will notify you of material changes through the App or via email
• Continued use of the App after changes constitutes acceptance of the modified Terms
• If you do not agree to the changes, you must stop using the App

14. Changes to the App

We reserve the right to:

• Modify, suspend, or discontinue any feature of the App
• Change or remove content from the App
• Impose limits on certain features or restrict access to parts of the App

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by the laws of the State of Utah, without regard to conflict of law provisions.

15.2 Arbitration

Any dispute arising from these Terms or the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

15.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis and you waive any right to participate in a class action lawsuit or class-wide arbitration.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Checkin regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control.
